What happened
Oleg Deripaska and Vladimir Chernukhin were in dispute for many years over a joint venture, the Moscow-based Trekhgornaya Manufaktura (TGM). An arbitral tribunal found that the conduct of Mr. Deripaska’s side was unfairly prejudicial to the counterparty’s rights and ordered it to buy out the stake of Mr. Chernukhin’s side for about $90M to $95M. Mr. Chernukhin’s side later relied on a Russian-language report, the Glavstroy Report, claiming that had it been disclosed, the tribunal would have awarded about $395M. The application under section 68 of the UK Arbitration Act was subsequently withdrawn, and the court found the report to be “not genuine.” On October 14, 2024, on the application of Mr. Deripaska and Filatona Trading, the High Court of England and Wales issued a Norwich Pharmacal order (an order for the disclosure of documents and information) requiring the law firm Quinn Emanuel, which had represented Mr. Chernukhin’s side, to disclose information about the consulting firm and the individuals involved in obtaining the report.
Why it is notable
A rare Norwich Pharmacal order against a law firm requiring disclosure of information about an intermediary who procured an allegedly forged document, in a long-running dispute between Russian businessmen over a Moscow asset.
