What happened
On December 16, 2022, a Russian-Mongolian joint venture won a dispute against a Chinese company at the Mongolian International Arbitration Centre (MIAC). A Chinese court recognized and enforced the MIAC award under the 1958 New York Convention, noting that the bilateral treaty between China and Mongolia does not apply to arbitral awards.
Why it is notable
The Chinese court’s recognition of the award indirectly protected the interests of the Russian participant in the joint venture. Both the award and its recognition and enforcement came after 2022.
