What happened

On February 20, 2024, the Arbitrazh Court of St. Petersburg and the Leningrad Region entered a judgment under Article 248.1 of the Russian Arbitrazh Procedure Code in favor of RusChemAlliance LLC. Public sources indicate that the courts of Kazakhstan refused to recognize and enforce the Russian court’s judgment, although the case file is not publicly available. Enforcement was refused because the defendant is not located in Kazakhstan and its location is known to the applicant, so under local procedural law the courts of Kazakhstan have no jurisdiction to recognize the Russian court’s judgment. The ground given by the courts is formal and contains no direct reference to the connection between the Russian judgment and Article 248.1 of the Russian Arbitrazh Procedure Code.

Why it is notable

The first known proceedings in Kazakhstan on the recognition of a Russian court judgment issued under Article 248.1 of the Russian Arbitrazh Procedure Code.
