Tens of thousands of US plaintiffs allege that glyphosate-based Roundup causes non-Hodgkin lymphoma. Bayer, which inherited the litigation through its $63B Monsanto acquisition, has committed more than $18B to resolving it, and in 2026 secured both a Supreme Court preemption win and a $7.25B class settlement that could finally cap the decade-old litigation.

On June 30, 2026, the Missouri Circuit Court judge overseeing Bayer’s $7.25B nationwide NHL class settlement rescheduled the final fairness hearing from July 9 to August 19, 2026. Objecting class members have appealed the June 17, 2026 federal remand order to the Eighth Circuit, and on July 1-2, 2026 Bayer announced it is consolidating its U.S. glyphosate business into a new subsidiary, Ruveon LLC, based in St. Louis, following the Supreme Court’s June 25, 2026 preemption ruling in Monsanto v. Durnell.

The litigation exploded after IARC classified glyphosate as ‘probably carcinogenic’ in 2015. A string of nine-figure and ten-figure jury verdicts, Johnson ($289M, 2018), Hardeman, and Pilliod ($2B, 2019), pushed Bayer into a roughly $10.9B settlement framework in 2020, but tens of thousands of claims were never resolved and new cases continue to be filed.

Bayer’s core legal strategy is federal preemption: that FIFRA’s federal labeling regime bars state-law failure-to-warn claims. The Third Circuit accepted a version of that argument in 2024, deepening a circuit split, and in June 2026 the Supreme Court resolved the question in Monsanto’s favor in Monsanto v. Durnell, even as juries continued to deliver eye-watering verdicts, including $2.1B in Georgia in March 2025. A $7.25B nationwide class settlement announced in February 2026 awaits final approval.
