What happened
After Google disabled the Google profiles and YouTube channels of sanctioned Russian media outlets, the outlets obtained judgments from Russian courts under Article 248.1 of the Russian Arbitrazh Procedure Code awarding an uncapped court penalty that grows exponentially until Google restores access to the accounts. The contracts contained clauses submitting disputes to the English courts or to arbitration in London. On January 22, 2025, on the application of Google LLC and Google Ireland, the High Court of England and Wales (Justice Henshaw) granted a final injunction against ANO TV-Novosti, NAO Tsargrad Media, and the Orthodox Television Foundation prohibiting enforcement of the Russian judgments outside Russia (an anti-enforcement injunction), together with an ancillary injunction barring them from seeking an anti-suit injunction against the Google group (an anti-anti-suit injunction). On March 31, 2025, the U.S. District Court for the Northern District of California issued a preliminary injunction against NAO Tsargrad Media prohibiting enforcement of the Russian judgment outside Russia.
Why it is notable
An example of a foreign corporate group protecting itself against the growing number of Russian court judgments issued under Article 248.1 of the Russian Arbitrazh Procedure Code. The first major case with a Russian element in which an English court prohibited foreign enforcement of judgments already issued, on the basis of exclusive jurisdiction clauses.
