How the list is built As of Oct 28, 2026
- Scope
- Arbitral awards and court judgments against states and state-owned entities that were issued and remain unpaid in whole or in part, including awards under challenge or vacated with further review pending (marked in the status).
- Sources
- Desk research of public sources: court dockets and opinions, PCA, ICSID and italaw records, the legal press (GAR, IAReporter, Law360), company releases and news reports. Points that rest on a single source or could not be confirmed are marked “not verified.” Compiled from Buzko Legal research and checked by hand, without automated monitoring.
- Headline amount
- The figure used for the order. Its basis (principal, judgment amount, with interest, claimed total or estimate) is stated with each award, so the order is indicative. Interest estimates are the reporting party’s.
- Citgo queue
- The priority order of the creditors in the court-ordered sale of PDV Holding shares in the U.S. District Court for the District of Delaware (17-mc-151, Crystallex). The sale order of November 29, 2025 approved a bid by Amber Energy (an Elliott affiliate) of about $5.9 billion for the attached judgments. Appeals were argued in the Third Circuit on October 21, 2026, and closing needs an OFAC license.
- Spain
- The investors’ own figure for the renewables awards against Spain (December 2025, 27 investors) is about €2.29 billion unpaid, including interest and costs. Spain argues that EU law bars payment of intra-EU awards, and the European Commission has treated payment of one of them as state aid.
- Terrorism judgments
- U.S. court judgments under the terrorism exception of the Foreign Sovereign Immunities Act are default judgments. Payments to such plaintiffs from the U.S. Victims of State Sponsored Terrorism Fund come from U.S. forfeitures, not from the respondent states, and are not counted as collection.
